Frank Cowan (46) underwent routine cervical spine surgery in the Sports’ Surgery Clinic, during which he was deprived of oxygen as a result of a mismanagement of his anaesthetic and suffer a hypoxic brain injury.
Frank is in a specialist care home requiring round the clock care. He is unable to communicate fully and cannot express when he is pain.
The SSC admitted that the anaesthetist was negligent and Frank’s wife, who claimed on behalf of her husband, was awarded €7.1M which award was approved by Justice Kevin Cross. The award will enable Frank being cared for in the family home. Justice Kevin Cross, while approving the settlement, also wished the family well for the future.
